Terms & conditions.

These Terms and Conditions govern the use of www.theeverydae.com.au and the purchase of any goods and services from it. www.theeverydae.com.au (“website” or “site”) is owned and operated by SJ Beardsley & SM Leys (ABN 32 810 661 298). When we say “you, your” etc., we mean the person using the site. When we say “our, we, us” etc., we mean SJ Beardsley & SM Leys trading as The Everydae. Please note that by using this website you agree to be bound by these Terms and Conditions including the disclaimers and limitations of liability. You also acknowledge that you have read and understood these Terms and Conditions.

Your rights
All goods supplied to you by us come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and may also be entitled to compensation for loss or damage. You are also entitled to a refund or replacement for a minor failure unless we elect to repair the goods at our expense. You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied to you fail to meet a consumer guarantee under the Australian Consumer Law.

Nothing in these Terms and Conditions excludes, restricts or modifies any condition, guarantee, warranty, right or liability conferred on you by law and unable to be negated or modified by contract and to the extent that any of these Terms and Conditions would (but for this provision) exclude, restrict or modify any such condition, guarantee, warranty, right or liability it is invalid and unenforceable. Save in relation to claims under the Australian Consumer Law, our maximum pecuniary liability to you in connection with or in relation to your use of our site and the purchase of products from us is limited to the aggregate of the amounts you have paid us for the goods or services.

The site may contain links to external websites that are not operated by us and for which we are not responsible. You agree that no representation or warranty is made by us in connection with those other websites and that the provision of the links does not indicate, expressly or impliedly, that we endorse the site or the products or services provided at those sites.

Prices and payment
You agree to pay for all products and services you order. Price provided in the online shop does not include delivery. Delivery Australia wide incur additional charges which will be be clearly stated when you add a product to the ‘cart’ and you enter your details at checkout. Please note that only one bundle and one delivery address can be fulfilled on one order. For multiple bundles or deliveries, please complete multiple orders.

We currently do not ship outside of Australia. Please contact us at hello@theeverydae.com.au if you wish to receive our product overseas. The price of products and services we offer may change without notice from time to time, but we will never change the price of anything you have already ordered and/or paid for. All prices quoted are in Australian dollars. All prices listed on the website include all applicable taxes unless otherwise specified. We accept payment by Visa, Mastercard & American Express & PayPal. Payment by card may be subject to processing fees, but if applicable you will be informed of these prior to finalising your purchase.

Ordering
From time to time you may order products from our site by placing an order through the Shop page of our site. By placing an order with us, you are making an offer to purchase the subject products and services from us. You are not permitted to withdraw an offer or order any products for resale to a third party. We reserve the right to accept or reject any offer you make us for any reason, including but limited to if the products requested are not available, payment is not processed successfully, we suspect your order is for commercial purposes, there is the possibility of fraud or there is an error in the price or description of the product you want to buy. Each offer you make and which is accepted by us creates a separate and binding agreement between you and us for the supply of the relevant products. For us to fulfil your order, we need some information from you including your name, contact details, billing address, delivery address and payment details. For information on how we obtain, store and use your personal information please see our Privacy Policy. You should receive a message on screen confirming receipt of your order once your payment has gone through and again when your order has been shipped. If you don’t receive such confirmations, there may have been a problem with processing your order. Please let us know if this happens, by emailing hello@stylebundle.com.au. Please be aware that we do not send products to PO Box addresses.

Liquor Information

Any liquor featured in our bundles is designed to be delivered as a gift and is packaged together with other homewares or gifts. The bundle is packaged and presented in such a manner with a gift card and wrapping that it is taken to be a gift. For all gifts with liquor included, YOU MUST ENSURE that the recipient is not a person who is less than 18 years old AND THAT not more than 1.5 litres of liquor is supplied to any recipient in any one day. If you fail to do so, the exemption which we enjoy from the provisions of the Liquor Control Reform Act 1998 may be prejudiced and we might be obliged to hold you responsible for penalties imposed on us or losses incurred by us.

Liquor is not able to be purchased on its own. A bundle must also be purchased (for example you can ‘add a bottle of wine’). The value of the liquor and its container must not be more than 50 per cent of the gift's sale price.

The Everydae fully supports the responsible service and consumption of alcohol - and does not sell to anyone under the age of 18 years. It is against the law to sell or supply liquor to, or to obtain liquor on behalf of, a person under the age of 18 years. You must be 18 years or older to place an order on our website (everydae.com.au) or to receive a delivery. If you check the box to confirm that you are 18 years or over, you take full responsibility for that statement. Persons placing orders and receiving orders MUST BE 18 YEARS or over. Couriers may ask for proof of identity and/or age."

Availability of product
Only a limited number of bundles are available due to the exclusive nature of some of the items. The Home and Shop pages of our website will be updated when particular bundles or products are no longer available, stating that the bundle has ‘sold out’. In some instances there will be the option to ‘pre-order’.

In the event that we reject an order, funds paid in relation to that order will be refunded in full as soon as reasonably practicable. You will be provided with e-mail acknowledgement of the rejection and refund.

We reserve the right to use substitute product of the same value in your bundles. This might occur due to stock issues during Covid-19 disruptions in supply chain.

Product care
Due to the nature of the material used and the hand-made element of the items, many of our ceramic, fabric, leather, sheepskin & sea-grass products are unique and therefore every item is slightly different. When we state measurements please be aware this could differ ever so slightly for each product. All weights and dimensions mentioned are approximate.

Copyright and trademark notice
This site is owned and operated by us. Unless otherwise specified, all material appearing on this website, including the text, site design, logos, graphics, icons and images, photographs, graphics, typefaces and other material as well as the selection, assembly and arrangement thereof (collectively "Content") is subject to applicable copyright laws. All audio and video clips are our sole property. You may use the Content only for the purpose of shopping on this site including placing an order on this Site and for no other purpose. No Content may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means whatsoever without our prior written permission. All rights not expressly granted herein are reserved.

Release & indemnity
You waive, release, discharge and relinquish any and all claims that you have now or may have against us that are connected with, arise out of, relate to or are incidental to the use of our website or products purchased from us. You agree to indemnify us and to keep us indemnified from and against any claim, loss, damage, tax, liability and/or expense that may be incurred by us arising out of or in connection with your use of our website or any of our products. We are not liable to you for any consequential, indirect, special, punitive, remote or incidental damages or for any loss of profit, loss of data, loss of goodwill, loss of business, loss of opportunity, increased financing costs, or any failure to realise anticipated savings or any type of commercial or economic loss. 

Miscellaneous
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision will be severed and the remaining provisions will remain in full force and effect. These Terms and Conditions are governed by the laws of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts of that State.

2020 Christmas Gifting

*To be eligible for 5% off your order you need to purchase a minimum if 10 bundles before COB Friday 30th October 2020. 5% discount applied to pre GST price as outlined in catalogue. Delivery charge additional to the discount. A FREE bottle of Mattara Rosé will be included in your order if you meet the above conditions.

Christmas Artwork Competition

The winner of the Christmas Artwork Competition will be required to supply high resolution artwork in the formats as requested by the founders of the everydae. Usage will be for 6 months from the date the winner is announced. Written consent outlining the above will be required before payment. Payment of $500 including GST to be paid via direct debit into one Australian bank account to the winner within 2 weeks of competition end. Instagram and website URL credited on artwork (once per piece) and featured on the everydae website. The Everydae reserves the right to not chose a winner should entries not satisfy the brief provided. Public voting on the top 3 designs as chosen by The Everydae will take place from 27th October 2020 for 2 days on Instagram stories. The Everydae reserves the right to request the winning artist to make minor modifications to ensure the design fits within production specifications.
